President-elect Donald Trump has asked the Supreme Court to delay legislation that would ban TikTok until after he is inaugurated. In short, Trump’s lawyer D. John Sauer wrote that the future president is looking for an opportunity to find a solution to the problem “by political means.”
The law requiring the ban or sale of TikTok is expected to go into effect on January 19, 2025, just one day before Trump’s inauguration. The brief calls the ban date “unfortunately out of date” and says the next president should have more time to work with TikTok. TikTok’s legal team cited similar concerns in its requests for a delay in the ban. The brief also cites Trump’s experience of “doing things” and his social media platform Truth Social.
“President Trump alone has the collective intelligence, electoral authority, and political will to negotiate a resolution to save the field while addressing the national security concerns raised by the Administration—concerns President Trump himself has acknowledged,” Sauer wrote.
Trump’s stance on TikTok is very different from the one he took during his first term, when he pursued a ban on the app in 2020. He also suggested that Microsoft “could make a deal, the right deal, so the Treasury.” of the United States gets a lot of money” without specifically explaining how such an agreement would work.
President Trump changed his opinion on banning TikTok during his second campaign. He told CNBC Squawk box in March that banning TikTok “will make Facebook bigger and I consider Facebook an enemy of the people, and of most media.”
The Supreme Court is scheduled to hear arguments on the ban on January 10.
